Public Offer of the Panda Store Cosmetics Online Shop

IE Darban Kyzy Aykeldi (legal address: Kyrgyz Republic, Bishkek city, Pervomaysky District, Kolmo residential area, 39 Kenesh Street), acting on behalf of the online store located at https://panda.kg, hereinafter referred to as the “Seller,” publishes this Public Offer for the remote sale and delivery of goods.


1. DEFINITIONS

The following terms are used in this Offer:

  • Panda Store – an online shop operating through the website https://panda.kg.

  • Online Store – a website containing a catalog of goods, their descriptions, and functions for placing orders.

  • Site Administration – authorized persons managing the operation of the website on behalf of the Seller.

  • Buyer – a legally capable individual who has reached the age established by the legislation of the Kyrgyz Republic and places orders on the website.

  • User – any person using the website and having access to it via the Internet.

  • Registered Client – a User who has registered on the website and has a personal account.

  • Electronic Sales System – the technical functionality of the website that allows the Buyer to select and pay for goods.

  • Website Content – any texts, images, product names, logos, graphics, and other design elements protected by copyright.

  • Personal Information – data provided by the Buyer during registration and/or order placement (name, phone number, also used as a WhatsApp contact, delivery address, email).

  • Remote Sale – the sale of goods via the Internet without physical inspection.

  • Order – the Buyer's request to purchase selected goods with delivery.

  • Goods – products listed on the website for sale.

  • Bonus Coins (Coins) – conditional virtual units credited to a Registered Client within the Panda Store loyalty program and used for partial payment of orders under the terms of this Offer.

  • Client Level – the status of a Registered Client in the loyalty program, determined by the website system (from level 1 to 10) depending on client activity.


2. GENERAL PROVISIONS

2.1. This Offer governs the relations concerning remote sale and delivery of goods between the Seller and the Buyer making a purchase through https://panda.kg.

2.2. This Offer is drawn up in accordance with Articles 396 and 398 of the Civil Code of the Kyrgyz Republic and constitutes a public proposal addressed to an unlimited number of persons.

2.3. By performing actions to place an order on the website, the Buyer unconditionally accepts the terms of the Offer and agrees to comply with them.

2.4. Photos and descriptions of goods on the website are for informational purposes only. The actual appearance of the product may slightly differ from the image.


3. ORDER PLACEMENT PROCEDURE

3.1. Orders can be placed:

3.2. Registration on the website is not mandatory but provides Registered Clients with additional benefits, including participation in the loyalty program.

3.3. To place an order, the Buyer must:

  • provide a name;

  • provide a delivery address (if delivery is required);

  • provide a contact phone number (also used as a WhatsApp contact for notifications);

  • optionally provide an email;

  • select the goods;

  • fill out the order form and choose a payment method.

3.4. All selected goods are displayed in the Buyer's cart until the order is placed.

3.5. The Seller has the right to request additional information to confirm the order. If not provided, the Seller is not responsible for order fulfillment.


4. PRICE AND PAYMENT OF GOODS

4.1. Prices are indicated on the website for the respective goods.

4.2. The Seller has the right to change prices unilaterally until the order is confirmed.

4.3. The Seller may require prepayment (up to 100%) before delivery.

4.4. Payment methods:

  • cash or cashless upon delivery (by courier) or for self-pickup;

  • cashless through all Kyrgyzstan electronic systems via Finik.

4.5. An order is considered paid once funds are received in the Seller's account or cash is received by the courier.


5. DELIVERY AND TRANSFER OF GOODS

5.1. Delivery is carried out:

  • by courier to the address specified by the Buyer;

  • or self-pickup from the point at Bishkek, 2/2 Orozbekova Street.

5.2. Delivery time consists of:

  • order processing time;

  • delivery time (specified when placing the order).


6. LOYALTY PROGRAM AND BONUS COINS

6.1. The Seller may provide Registered Clients with participation in the Panda Store loyalty program.

6.2. Within the loyalty program, a Registered Client is assigned a Client Level from 1 to 10. The level is determined automatically based on client activity, including but not limited to:

  • completed purchases;

  • referral activity;

6.3. Depending on the Client Level, Bonus Coins may be credited to the Registered Client as cashback.

6.4. Bonus Coins are displayed on the virtual balance in the client’s personal account on the website and are not monetary funds.

6.5. Bonus Coins may be used for partial payment of subsequent orders on the website.

6.6. Limitations on the use of Bonus Coins:

  • no more than 30% of a single order's value can be paid with Bonus Coins;

  • Bonus Coins cannot be exchanged for cash;

  • Bonus Coins cannot be transferred to third parties.

6.7. The Seller has the right to change the terms of the loyalty program, the procedure for crediting and using Bonus Coins, and Client Levels. The current terms are published on the website.

6.8. In case of abuse, technical errors, or violations of the Offer, the Seller may cancel Bonus Coins in full or in part without compensation.


7. LIABILITY

The website and the Seller are not responsible for:

  • malfunctions of the website or payment systems;

  • errors caused by technical malfunctions, malware, or actions of third parties;

  • the operation of communication channels and payment services;

  • errors in data entered by the Buyer;

  • failures in banking settlement systems.


8. RETURN OF GOODS

8.1. Refunds are possible only if the Goods have not been opened.

8.2. In case of same-day payment cancellation, the amount is not charged to the Buyer’s card.

8.3. In case of later cancellation, provided that none of the purchased goods have been opened, the refund is made automatically by the bank or in cash without additional notification to the Buyer.


9. FINAL PROVISIONS

9.1. The terms of this Offer apply to all Buyers of the website.

9.2. By placing an order, the Buyer consents to the processing of their personal data to the extent necessary to fulfill the order and to receive automatic notifications via WhatsApp at the provided phone number.

9.2.1. WhatsApp notifications are for informational purposes only and may include:

  • information about the composition and details of the order;

  • notifications of order status (accepted, ready for pickup, in transit, completed, cancelled, returned);

  • notifications of Bonus Coins credited;

  • notifications of Client Level upgrades.

Notifications are NOT marketing messages.

9.3. The Seller reserves the right to make changes to the text of the Offer at any time without prior notice. The current version is available on https://panda.kg.

9.4. The Seller and payment systems may charge fees, which the Buyer is notified of before order confirmation.

9.5. By placing an order, the Buyer confirms their legal capacity and the appropriate age under the laws of the Kyrgyz Republic.

9.6. All disputes are resolved through negotiation. If no agreement is reached, the dispute is settled in court in accordance with the legislation of the Kyrgyz Republic.
